These Terms of Service ("Terms") govern your access to and use of NewRVParts.com and NewRVParts.ca (collectively, the "Site") and all purchases made through the Site.

Okanagan RV Parts ("Company", "we", "us", or "our") operates the Site and supplies new RV parts, accessories, appliances, components, and related products.

By accessing the Site, interacting with its customer-support or artificial-intelligence features, or completing a purchase, you ("User", "Customer", or "Buyer") agree to these Terms together with our Return & Refund Policy, Shipping Policy, Privacy Policy, and Legal Notice, each of which is incorporated into these Terms by reference and forms part of the agreement between you and Okanagan RV Parts.

"Voluntary return" means a return that is not required under applicable consumer protection or other mandatory law.

Nothing in these Terms is intended to exclude, restrict, or waive any right, remedy, warranty, condition, or protection that cannot lawfully be excluded under applicable law.


1. Products, Representations & Availability

1.1 New RV Parts & Manufacturer Warranties

Products sold through the Site are new unless expressly stated otherwise.

Products may be covered by a manufacturer warranty where offered by the applicable manufacturer.

Unless otherwise expressly stated:

  • Okanagan RV Parts does not provide a separate manufacturer warranty.

  • Warranty eligibility, coverage, duration, and remedies are determined by the applicable manufacturer.

  • Manufacturer warranty procedures may require diagnosis, documentation, serial numbers, photographs, proof of purchase, or inspection.

  • Certain manufacturers may require customers to deal directly with them or an authorized service provider.

  • Installation, removal, labour, diagnostic, travel, and related expenses are not covered by Okanagan RV Parts unless expressly agreed otherwise or required by applicable law.

We will provide reasonable assistance, including proof of purchase, available product information, or manufacturer contact information where appropriate.

1.2 Electronic Components

Electronic components, including circuit boards, control boards, electronic modules, sensors, igniters, displays, and similar electrical components, are FINAL SALE and are not eligible for voluntary return or refund, except where required by applicable law or expressly permitted under our published policies.

Customers are responsible for proper diagnosis and compatibility verification before ordering electronic components.

Electronic components may be inspected, documented, tested, or serialized before shipment where appropriate.

1.3 Product Listings, Pricing Errors & Availability

We make reasonable efforts to maintain accurate product descriptions, pricing, specifications, compatibility information, images, and inventory availability.

However, errors, supplier inventory changes, synchronization delays, automated-system errors, AI-generated errors, and inventory discrepancies may occur.

Subject to applicable law, we reserve the right to:

  • Correct pricing, description, image, specification, compatibility, or inventory errors.

  • Update product information without prior notice.

  • Correct inaccurate information generated or displayed by automated or AI-powered features.

  • Cancel an order affected by a material pricing, listing, compatibility, or inventory error.

  • Discontinue or remove products from sale.

  • Correct errors discovered after an order has been submitted.

Where an order is cancelled before fulfillment because of such an error, any amount collected for the affected product will be refunded.

Displaying a product as available on the Site does not guarantee that supplier inventory will remain available until fulfillment has been completed.

Nothing in these Terms permits false or misleading representations.


2. Pricing, Payment & Fraud Prevention

Prices are displayed in Canadian dollars, U.S. dollars, or another currency where specifically indicated.

Prices and availability may change without notice before an order is completed.

Taxes, shipping charges, brokerage fees, duties or tariffs (where applicable), and other applicable charges are calculated separately unless expressly stated otherwise.

By placing an order, the Buyer authorizes us and our payment service providers to:

  • Process or authorize payment.

  • Perform fraud screening.

  • Verify transaction information.

  • Take reasonable steps to prevent unauthorized or fraudulent transactions.

We reserve the right, subject to applicable law, to:

  • Refuse or cancel an order.

  • Request additional identity or payment verification.

  • Hold an order pending fraud review.

  • Decline transactions identified as high-risk.

  • Require signature confirmation for high-value or higher-risk shipments.

Orders reasonably suspected of fraud, unauthorized payment activity, abusive reshipping activity, or deliberate policy misuse may be cancelled.


3. Order Acceptance & Supplier Fulfillment

Submitting an order through the Site constitutes an offer to purchase the products identified in the order.

All orders remain subject to acceptance, payment authorization, fraud screening, product availability, supplier availability, and fulfillment requirements.

Most products sold through the Site are fulfilled through our authorized supplier network.

As a result:

  • Products may be held at third-party supplier warehouses.

  • Products may ship directly from a supplier warehouse to the Buyer.

  • Items within the same order may ship separately.

  • Products may ship from different warehouses.

  • Inventory availability may change between checkout and fulfillment.

  • Carrier selection may vary depending on warehouse, destination, product size, weight, and other shipping requirements.

An order confirmation does not guarantee that inventory remains available until fulfillment has been completed.

If a product becomes unavailable before shipment, we may contact the Buyer regarding an alternative product, revised availability, backorder, or cancellation and refund of the affected item.

Additional fulfillment terms are governed by our Shipping Policy.


4. Shipping, Delivery & Risk

Delivery estimates are provided for convenience and are NOT guaranteed unless expressly stated otherwise.

The Buyer is responsible for:

  • Providing a complete and accurate shipping address.

  • Providing a physical delivery address where required by the applicable carrier.

  • Including apartment, suite, unit, lot number, business name, gate code, or other delivery information where required.

  • Monitoring shipment tracking.

  • Ensuring the delivery location is accessible and secure.

  • Being available for signature-required or scheduled freight deliveries where applicable.

We may require signature confirmation on selected shipments.

Risk of loss passes to the Buyer in accordance with applicable law and the applicable carrier's terms where legally permitted.

Carrier tracking records, proof of delivery, delivery photographs, GPS information, delivery scans, or signatures may be used as evidence of delivery and fulfillment where applicable.

To the fullest extent permitted by applicable law, we are not responsible for:

  • Carrier delays.

  • Weather-related interruptions.

  • Customs delays.

  • Delivery access problems.

  • Theft after confirmed delivery.

  • Porch piracy.

  • Failed delivery attempts caused by incorrect or incomplete customer information.

Claims involving loss or damage in transit may need to be handled through the appropriate carrier, supplier, manufacturer, or insurance process depending on who controls the shipment and carrier account.

We will provide reasonable assistance with documentation and communication where appropriate but cannot guarantee claim approval.

All additional shipping terms are governed by our Shipping Policy.


5. Additional Shipping Charges

Shipping charges are calculated using information available at checkout.

In certain circumstances, additional shipping charges may be required before an order can be shipped, including because of:

  • Remote or rural delivery locations.

  • Oversized or overweight products.

  • Freight requirements.

  • Carrier surcharge adjustments.

  • Address correction requirements.

  • Specialized delivery requirements.

  • Shipping calculation errors beyond our reasonable control.

Where an additional shipping charge is identified before shipment:

  • The Buyer will be contacted.

  • No additional payment will be processed without authorization.

  • The order may be held until the applicable charge is paid.

If the Buyer declines the additional charge, the affected order may be cancelled before shipment and any applicable payment collected will be refunded in accordance with our policies.


6. Returns, Refunds & Final Sale Items

Return eligibility is governed by our Return & Refund Policy.

In general:

  • Electronic components are final sale for voluntary returns unless otherwise stated.

  • Certain other product categories may be designated FINAL SALE.

  • Eligible products may be returned only when all requirements in our Return & Refund Policy are satisfied.

  • Products must be unused, uninstalled, and meet applicable condition and packaging requirements to qualify for an eligible voluntary return.

  • Restocking fees may apply.

  • Original outbound shipping and other shipping-related charges may be non-refundable.

  • Return shipping may be the Buyer's responsibility.

  • Return authorization must be obtained before eligible merchandise is shipped back.

Return requests for eligible products must generally be submitted within the timeframe stated in our Return & Refund Policy.

Refunds are not issued until required return procedures are completed and, where applicable, returned merchandise has been received, inspected, and approved.

A product being selected, suggested, identified, cross-referenced, or recommended by an AI-powered chatbot, automated system, search function, compatibility tool, customer-support feature, or similar technology does not by itself alter the product's return eligibility or create a right to a return, refund, reimbursement of shipping charges, or waiver of an otherwise applicable restocking fee.

Customers remain responsible for independently verifying compatibility before purchase as described in these Terms and our Return & Refund Policy, except to the extent otherwise required by applicable law.


7. Undeliverable, Refused & Returned Shipments

Customers are responsible for providing complete and accurate delivery information.

If a shipment is returned to Okanagan RV Parts or the applicable supplier because of circumstances including:

  • Incorrect or incomplete address.

  • Refused delivery.

  • Unclaimed shipment.

  • Failure to accept required delivery.

  • Failure to arrange freight delivery.

  • Carrier inability to access the location.

  • Other circumstances outside our reasonable control.

The Buyer may be responsible for:

  • Additional outbound shipping.

  • Return shipping charges.

  • Re-delivery charges.

  • Applicable restocking fees.

Refunds, where applicable, may be delayed until the merchandise has been returned to and inspected by the applicable supplier or Okanagan RV Parts.

Any additional shipping charge required before re-shipment must be paid before the order is released again.

8. Installation, Compatibility & Buyer Responsibility

RV parts frequently vary by model, production year, serial number, dimensions, installation configuration, manufacturer revision, original equipment, and previous modifications.

A product that appears similar to an existing component, is associated with the same general appliance or RV model, or is suggested as a possible replacement is not necessarily compatible with a particular application.

The Buyer is responsible for:

  • Verifying compatibility before purchase.

  • Confirming manufacturer part numbers.

  • Confirming applicable model and serial-number requirements.

  • Checking manufacturer documentation where appropriate.

  • Measuring installation openings and relevant dimensions where applicable.

  • Confirming electrical, propane, plumbing, ventilation, mounting, and other installation requirements.

  • Confirming whether a superseded or replacement part number is appropriate for the Buyer's particular application.

  • Obtaining professional installation or diagnosis where appropriate.

  • Independently verifying recommendations generated by AI-powered or automated features before purchasing or installing a product.

Okanagan RV Parts is not responsible, to the fullest extent permitted by applicable law, for losses resulting from:

  • Incorrect customer-selected fitment.

  • Reliance on an incorrect or incomplete AI-generated or automated compatibility recommendation.

  • Improper installation.

  • Incorrect diagnosis.

  • Product misuse.

  • Unauthorized modification.

  • Failure to follow manufacturer instructions.

Installation should be performed by a qualified technician where appropriate.

The fact that a product can physically connect, fit, or be installed does not necessarily establish that it is compatible with a particular RV, appliance, system, model, or application.

For safety-critical matters involving propane, fuel systems, high-voltage electricity, structural components, towing systems, braking systems, or other potentially hazardous installations or repairs, customers should consult appropriate manufacturer documentation and a qualified technician.


9. AI-Powered Chatbot, Automated Guidance & Product Recommendations

The Site may provide an AI-powered chatbot, virtual assistant, automated customer-support system, compatibility tool, product recommendation system, automated search feature, or similar technology to help customers navigate the Site, locate products, understand product information, and obtain general customer-service or technical information.

These systems may generate responses concerning matters including:

  • Product identification

  • Product recommendations

  • Compatibility and fitment

  • Manufacturer part numbers

  • Replacement or superseded part numbers

  • Product specifications

  • Dimensions

  • Installation

  • Troubleshooting

  • Product availability

  • Pricing

  • Shipping

  • Returns and refunds

  • Warranty information

  • Store policies

  • Other product or customer-service information

9.1 AI Responses May Be Inaccurate

Artificial-intelligence systems generate responses algorithmically. Despite efforts to provide useful information, AI-generated or automated responses may be inaccurate, incomplete, outdated, inconsistent, misunderstood, or otherwise incorrect.

An AI system may, among other things:

  • Misidentify a product.

  • Recommend an incompatible product.

  • Provide an incorrect part number.

  • Incorrectly interpret a model or serial number.

  • Provide inaccurate dimensions or specifications.

  • Incorrectly identify a superseded or replacement part.

  • Omit an important compatibility restriction.

  • Misinterpret information supplied by a customer.

  • Provide outdated product, inventory, pricing, shipping, warranty, return, or policy information.

  • Generate information that does not appear in manufacturer documentation or other authoritative sources.

The output of an AI-powered or automated feature should therefore be treated as general informational assistance and a starting point for further verification, not as authoritative technical information or a guarantee.

9.2 No Guarantee of Compatibility or Fitment

A product recommendation, identification, cross-reference, compatibility statement, or other response generated by an AI-powered or automated feature does NOT constitute a guarantee that a product will fit, function with, replace, or otherwise be compatible with the Buyer's RV, appliance, equipment, or application.

Before ordering, the Buyer must independently verify relevant information, which may include:

  • Manufacturer

  • Manufacturer part number

  • Exact model number

  • Serial number

  • Production date or revision

  • Dimensions

  • Electrical specifications

  • Propane or fuel requirements

  • Plumbing connections

  • Mounting configuration

  • Ventilation requirements

  • Required accessories

  • Manufacturer replacement or supersession information

  • Other application-specific requirements

Where compatibility cannot be established with reasonable certainty, customers should consult the applicable manufacturer and/or a qualified RV technician before purchasing or installing the product.

9.3 AI Recommendations Do Not Modify Return Eligibility

Purchasing a product because it was recommended, identified, suggested, or discussed by an AI-powered chatbot or other automated feature does not make an otherwise non-returnable product returnable and does not automatically entitle the Buyer to reimbursement of shipping charges, return shipping, labour, diagnostic costs, installation costs, or other expenses.

Return eligibility remains governed by the Return & Refund Policy, these Terms, and applicable law.

This includes circumstances where an AI-generated recommendation is subsequently determined to have been incorrect, incomplete, or unsuitable for the Buyer's particular application, except where applicable law requires otherwise.

9.4 AI Responses Do Not Override Published Policies

An AI-generated statement concerning:

  • Returns

  • Refunds

  • Shipping

  • Delivery

  • Pricing

  • Inventory

  • Warranty

  • Compatibility

  • Final-sale status

  • Restocking fees

  • Manufacturer requirements

  • Any other store policy or contractual term

does not amend, waive, replace, or override the applicable product listing, these Terms, the Return & Refund Policy, Shipping Policy, Privacy Policy, Legal Notice, manufacturer documentation, or other applicable published terms.

If an AI-generated response conflicts with an applicable published policy or manufacturer documentation, the applicable published policy or authoritative manufacturer documentation controls, subject to applicable law.

9.5 No Professional Technical Advice

AI-powered and automated features are not qualified RV technicians, electricians, gas fitters, engineers, mechanics, or manufacturer-authorized service representatives.

AI-generated information should not be relied upon as a substitute for professional diagnosis, manufacturer instructions, technical documentation, or advice from an appropriately qualified technician.

Customers should not undertake potentially hazardous installation, diagnosis, modification, or repair work solely on the basis of AI-generated instructions.

9.6 Customer-Supplied Information

The usefulness and accuracy of an AI-generated response may depend on the information supplied by the customer.

Customers should provide accurate and complete information when requesting assistance, including exact model numbers, manufacturer part numbers, serial numbers, dimensions, photographs, or other relevant information where appropriate.

An AI system may be unable to identify missing information or determine that information supplied by a customer is inaccurate.

9.7 Privacy of AI Interactions

Information submitted through AI-powered or automated features may be processed as described in our Privacy Policy.

Customers should not submit passwords, complete payment-card numbers, government identification numbers, or other highly sensitive or confidential information through a chatbot unless an authorized feature specifically and securely requests such information.


10. Technical Information, Diagrams & Cross-References

The Site may include compatibility information, diagrams, technical descriptions, specifications, installation information, part-number cross-references, manufacturer information, or other technical resources.

Such information is provided for general informational and product-identification purposes.

Although we make reasonable efforts to provide useful information:

  • Technical information may contain errors.

  • Manufacturer specifications may change without notice.

  • Part numbers may be superseded or replaced.

  • Compatibility may depend on serial number, production revision, model variation, original equipment, or installation configuration.

  • Manufacturer documentation should be consulted where appropriate.

  • Third-party information may be inaccurate, incomplete, or outdated.

Customers should independently verify all critical specifications, part numbers, dimensions, and compatibility before purchasing or installing a product.


11. Product Images

Product images may include:

  • Original photographs

  • Manufacturer-supplied images

  • Stock images

  • Representative examples

Actual products may vary in:

  • Colour

  • Packaging

  • Labels

  • Branding

  • Manufacturer revisions

  • Minor cosmetic appearance

Images are provided for reference and identification purposes and should be reviewed together with the applicable product description, part number, specifications, and compatibility information.

Manufacturer and third-party images remain subject to the intellectual property rights of their respective owners.


12. Intellectual Property

Unless otherwise stated, all original content created and owned by Okanagan RV Parts, including original text, photographs, graphics, guides, diagrams, website content, and other original materials, is protected by applicable intellectual property laws.

Manufacturer trademarks, logos, product names, model numbers, technical specifications, photographs, and other third-party materials remain the property of their respective rights holders where applicable.

Except as permitted by law, proprietary content owned by Okanagan RV Parts may not be reproduced, republished, systematically scraped, distributed, modified, or commercially exploited without prior written permission.

13. Limitation of Liability

To the fullest extent permitted by applicable law, Okanagan RV Parts will not be liable for indirect, incidental, special, or consequential losses arising from the purchase, installation, use, or inability to use a product or the Site, including use of or reliance upon AI-powered or automated features.

This may include, where legally permissible:

  • Loss of income

  • Loss of use

  • Downtime

  • Installation costs

  • Removal costs

  • Reinstallation costs

  • Diagnostic costs

  • Labour charges

  • Travel expenses

  • Consequential damages

To the fullest extent permitted by applicable law, Okanagan RV Parts is not responsible for indirect, incidental, special, or consequential losses arising from inaccurate, incomplete, outdated, or otherwise incorrect information generated by an AI-powered or automated feature.

This limitation applies whether the claim is based in contract, negligence, tort, statute, equity, or otherwise, to the fullest extent permitted by applicable law.

Where liability cannot legally be excluded, our liability will be limited only to the extent permitted by applicable law.

Nothing in these Terms excludes liability or consumer rights that cannot lawfully be excluded or limited.


14. Indemnification

To the fullest extent permitted by applicable law, the User agrees to indemnify and hold harmless Okanagan RV Parts from third-party claims, losses, liabilities, or expenses resulting from:

  • Unlawful use of the Site.

  • Unauthorized modification or misuse of a product.

  • Violation of another person's intellectual property rights.

  • Fraudulent or intentionally misleading activity.

  • Material violation of these Terms.

This provision does not require a consumer to indemnify us for losses caused by our own unlawful conduct or for liabilities that cannot legally be transferred.


15. Chargebacks & Payment Disputes

Customers are encouraged to contact us first if they believe there is a problem with an order so that we have an opportunity to investigate and resolve the matter.

Where a payment dispute or chargeback is submitted, we reserve the right to provide relevant supporting information to the payment processor, card issuer, bank, or dispute-resolution provider, including:

  • Order records

  • Carrier tracking

  • Delivery confirmation

  • Proof of delivery

  • Delivery photographs or GPS confirmation where available

  • Signature records

  • Customer communications

  • Relevant chatbot or automated-support communications where applicable

  • Product descriptions

  • Applicable policies

  • Refund or return records

We reserve all rights to defend, contest, or respond to payment disputes using any lawful evidence available, including order records, carrier tracking information, delivery confirmations, customer communications, applicable policies, and any other relevant documentation.

Nothing in this section restricts a customer from exercising rights available through their card issuer, payment provider, consumer protection law, or other applicable law.


16. Privacy

Personal information collected through the Site, including information submitted through AI-powered chatbot or customer-support features, is handled in accordance with our Privacy Policy and applicable privacy law.

Payment processing, AI functionality, customer support, and certain website functions may also be provided by third-party service providers subject to applicable privacy requirements and their respective privacy practices.


17. Force Majeure

Okanagan RV Parts shall not be liable for any delay or failure to perform its obligations where such delay or failure results from events beyond our reasonable control, including but not limited to:

  • Natural disasters

  • Wildfires

  • Floods

  • Severe weather

  • Pandemics

  • Government actions

  • Labour disputes

  • Supplier or warehouse interruptions

  • Carrier delays or interruptions

  • Utility failures

  • Internet or telecommunications outages

  • Cybersecurity incidents

  • War

  • Civil unrest

  • Acts of terrorism

  • Any other event beyond our reasonable control

Where such circumstances occur, affected obligations will be suspended only for the duration of the event and will resume as soon as reasonably practicable.


18. Governing Law & Consumer Rights

These Terms are governed by the laws of the Province of British Columbia and the applicable federal laws of Canada, subject to mandatory consumer protection laws or other legal rights that may apply to a particular transaction.

Nothing in these Terms excludes, restricts, waives, or limits any statutory right, remedy, warranty, condition, or consumer protection that cannot lawfully be excluded.

Any dispute will be dealt with through the court, tribunal, regulator, payment process, or other forum having jurisdiction under applicable law.


19. Changes to These Terms

We may update these Terms from time to time to reflect changes to:

  • Our business practices

  • Website functionality

  • Products or services

  • AI-powered or automated functionality

  • Supplier or fulfillment practices

  • Applications or integrations

  • Applicable legal requirements

The current version will be posted on the Site together with the date of the most recent revision.

Changes will apply prospectively to the extent required by applicable law.


20. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.


21. Entire Agreement

These Terms, together with the policies expressly incorporated by reference, constitute the applicable terms governing use of the Site and purchases made through it, subject to any additional written terms specifically agreed to for a transaction and any rights provided by applicable law.

An automated or AI-generated communication does not constitute an amendment to these Terms or another published policy unless Okanagan RV Parts expressly confirms the amendment through an authorized written agreement or updates the applicable published policy.
